TERMS AND CONDITIONS: OREO DUNKED PROMOTION
STAND A CHANCE TO WIN A TRIP TO EITHER LOS ANGELES VALUED AT R125 000 OR BARCELONA VALUED AT
R85 000 (“GRAND PRIZE”) AND/OR 1 OF 7 WEEKEND GETAWAYS TO THE VALUE OF R10 000 EACH

Please read these terms and conditions carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions.  If you do not agree with these Terms and Conditions, please do not participate.

The terms and conditions set out below apply to all participants submitting entries for the Oreo Dunked Promotion. Please refer to these Facebook pages for the current Terms and Conditions for this Promotion: www.oreodunk.co.za

THE PROMOTION:
Oreo Dunked Promotion (“the Promotion”) conducted by Mondelez South Africa (Pty) Limited, 13 Harrowdene Office Park, Kelvin Drive Woodmead, Sandton, 2191, Tel: 011 253 4000 (“the Promoter”).

    1. PROMOTION PERIOD:
      • The Promotion will run from the 16th of February 2017 to the 31st of May 2017 (“the Promotion Period”). No entries received after midnight on the 31st of May 2017 will be accepted.
      • The duration of the Promotion may be extended or curtailed at the discretion of the Promoter.
      • Promotion is valid while stocks last. The qualifying products are subject to stock availability at the time of purchase and will vary by store.
    2. WHO MAY ENTER:
      1. All Participants :
        • Must be a natural person and be 18 (eighteen) years of age at the date of the entry.
        • Must be a citizen of the Republic of South Africa and/or a legal resident of the country.
        • Must be in possession of a valid South African Identity Document; work permit and/or Driver’s License, whichever is applicable to the Promotion.
      2. All Participants and potential travellers must be in possession of a valid passport meeting the following requirements;
        • the passport must be valid for at least (6) six months after the return date of the  Grand Prize trip
        • the passport book must have at least(6) six full, blank pages available
        • In addition the participant and travellers must have no criminal record, be in good health and physically fit to be able to travel.  The participant/winner will be required to undergo a Vetting process to confirm eligibility. The participant/winner must supply the children’s Unabridged Birth Certificates and valid Visas before the 8th August 2017 and all necessary required parental/guardian consents of both parents where applicable.
        • Obtaining an Unabridged Birth Certificate to travel to the United States or Spain is the responsibility of the winner and the cost thereof is excluded from the prize.
        • The costs pertaining to the application for standard Visa entry documents for the United States of America/ Spain will be included in the prize package and will be limited to winner and one potential traveller only
      3. Participation in this competition excludes directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoter, their Agencies, organizers and participating stores, of the Competition and the spouse, life partner, parent, child, brother, sister, business partner or associate of any of the said persons.
    3. HOW TO QUALIFY FOR THE PROMOTION
      1. To qualify for the Promotion, each participant must purchase any two of the products listed below:
        • Oreo Original (176g)
        • Oreo Chocolate Crème (176g)
        • Oreo Golden (176g)
      2. Participants must dial *120*7226# and follow the prompts, which will include entering the last 4 (four) digits of both valid participating product barcodes. Do not SMS in to this number.
      3. The products mentioned above must be purchased at any store in South Africa. Participants are required to keep their original proof of purchase.
      4. USSD entries cost 20c per 20 seconds. Free minutes do not apply. Incomplete entries may be billed by your service provider
      5. The Promoter shall not be responsible for telecommunication failure on the part of the Participant’s service provider.
      6. Due to network restrictions, the USSD session will timeout after 120 seconds. If a Participant successfully enters the barcode before the session times out, their entry will be considered valid.
      7. Participants must enter from a mobile number that is owned by themselves. Participants may be asked to provide proof of ownership of said mobile number. If a participant is requested to provide proof of ownership and is unable to, the participant may be disqualified, at the sole discretion of the Promoter.
    4. CAN I QUALIFY MORE THAN ONCE FOR THE PROMOTION?
      1. Multiple entries will be permitted but will be limited to 3 (three) entries within a 24 (twenty four) hour period, subject to each entry being submitted separately and in accordance with entry requirements. Participants will be notified when they have reached their entry limit. Should there be any dispute in this regard; the Promoter’s decision will be final.
      2. A participant may not win more than one Weekend Getaway Prize within the Promotion Period. Winners of a Weekend Getaway Prize will be eligible for a chance to win the Grand Prize. The Promoter reserves the right to withhold prizes from any such person, and to reclaim any such prize if a breach of this rule is subsequently discovered.
      3. Only 1 (one) participant will be awarded the Grand Prize.
    5. COMPETITION ENTRY MECHANICS:
      1. The Grand Prize, is valued either at R125 000 for Los Angeles or R 85 000 for Barcelona in total. The Participant has a choice between either a Trip to Los Angeles to meet Christina Aguilera or a Trip to Barcelona to meet  Neymar Jnr for two people (“Grand Prize”).
      2. A random draw will be held on the 6th of June 2017 in the presence of an independent auditor. All entries from the entire campaign period will be collated for the purpose of the random draw. 10 entries will be selected using a computer generated random selection software (1 finalist and 9 reserves) The finalist will be contacted and vetted according to the entry requirements. Should the finalist meet the entry requirements, he/she will be declared the winner. Should the finalist not meet the entry requirements, they will be disqualified and a new finalist will be selected from the audited reserve list, in descending order.
      3. The Winner will be announced on the 8th June 2017 on the Oreo Facebook page and www.oredunk.co.za.
      4. The Winners of the Weekend Getaways will be announced at intervals throughout the campaign on Facebook .
    6. PRIZES
      1. The Promotion will afford the participant a chance to win the Grand Prize, to the value of R125 000 for Los Angeles Barcelona and R 85 000 for Barcelona and/ or 1 of 7 Weekend Getaways valued at R10 000 each.
        • Grand Prize:
          1. The prize consists of one five day / four night trip for two people to Los Angles (up to the value of R125 000) or Barcelona (up to the value of R85 000). Trip consists of:
            • Return Economy flights for two people (winner and their guest) from a major airport nearest the winner’s residence in South Africa to Los Angeles or Barcelona on Sponsor designated dates in December;
            • Connecting flights within South Africa to a major airport if required
            • Five days / four nights 4* hotel shared accommodations  including breakfast
            • Return transfers between airport/hotel in Los Angeles or Barcelona
            • A pre-arranged tour of Los Angeles or Barcelona
            • A pre-arranged hospitality event with Oreo
            • Standard Visa application costs and assistance with the Visa application process
            • “Travel Insurance will be provided to the Winner and the Travellers” and then a detailed breakdown of what will be covered by the travel insurance will be given to the winner and traveler before departure.
            • A gift bag and R20 000 spending money for the winner to be shared between winner and their guest, which will cover meals and spending money which will be loaded onto an international debit travel card.
            • Spending money is subject to exchange rates.
            • All additional travel (outside of the stipulated travel itinerary) will be for the winner and partner’s own account
          2. Grand Prize – Proposal
            • The Grand PrIze consists of a 5 day / 4 night Trip to either Los Angeles or Barcelona, where consumers will have the chance to let their wonder loose with either Christina or Neymar by sharing the fun of Dunking Oreo Cookies in milk with other guests from around the world.
          3. TRIP Itinerary either Los Angeles or Barcelona
            • Day 1 – Arrival
              Visit The Oreo Hospitality Room where Winners will receive their welcome gift, filled with all the essentials to practice their dunking skills. Light snacks and beverages will also be available to guests throughout the day.
            • Day 2 – Welcome Reception
              Mingle With Fellow Winners and enjoy a tasting of your favorite Oreo recipes and local cuisine.  This casual reception will take place in the evening and allow guests to meet one another and prepare for the Big Day!
            • Day 3 – Oreo Dunk Day
              Guests are invited to participate in an Oreo Dunking Activity that will showcase their dunking skills and an exclusive Celebrity Experience
            • Day 4 – Free Day
              Give guests the chance to explore the city and what matters most to them. There are no global activities planned for this day so guests can take advantage of the activity suggestions available to them and explore on their own
            • Day 5 – Return Home
              It’s time for guests to head back home, taking their Oreo dunk memories with them to share with their friends & family
            • Weekend Getaways:
              In addition to the Grand Prize, participants stand a chance to win 1 of 7 Weekend Getaways for two valued at R10 000.00 each to a pre-selected destination within the Republic of South.
              The Weekend Getaway packages include accommodation (2 nights), flights and car hire for the winner and partner.
              Getaway  destinations are subject to availability
      2. Prizes are not transferrable or exchangeable and may not be redeemed for cash and should they not taken up for any reason, may be forfeited or be the subject of a separate draw or be allocated at the Promoters’ discretion to another winner.
      3. The costs pertaining to the application for standard Visa entry documents for the United States of America / Spain will be included in the prize package and will be limited to each individual traveller.
      4. Should the Grand Prize winners visa application be declined, the next valid entrant from the original audited draw will be selected as a replacement
      5. The winner of the Grand Prize must have all required documentation as detailed in Clause 2 above.
    7. AWARDING OF PRIZES
      1. GRAND PRIZE
        • The Promotion will afford the participant a chance to win the Grand Prize valued at either  R125 000 ( Los Angeles)  or R 85 000 ( Barcelona)
        • The Grand Prize draw will take place on the 6th of June 2017 via a random system generated draw and will be overseen by a certified independent auditing company. The winner will be contacted within 72 hours of the draw.
      2.  WEEKEND GETAWAYS
        • The Promotion will afford the participant a chance to win the 1 of 7 Weekend Getaways for two valued at R10000.00 each to a pre-selected destination within the Republic of South Africa.
        • The getaway may be to one of the following destinations but not limited to:
          1. W. Cape – 3* Marriott Waterfront / Stellenbosch Hotel Winelands,
          2. E. Cape – 3* Marriott Outeniqua, 5* Oubaai Hotel Golf&Spa
          3. Gauteng & North West – 3* Melrose Place Guest House Sandton / Kingdom Hotel Pilanesburg
          4. KZN – 3* Urban Park Or Marriott, Umhlanga, Garden Court South Beach, Fairmont Zimbali Lodge
        • The weekend getaway prize draws will take place fortnightly via a random selection draw winner selector on the following dates:
          1st of March 2017
          15th of March 2017
          29th of March 2017
          12th of April 2017
          26th of April 2017
          10th of May 2017
          24th of May 2017
      3. All prize finalists will be required to provide their original till slip for their purchase, dated and timed before their entry date and time, as proof of purchase for the qualifying product upon receiving a phone call to announce that they are a finalist. Should the finalist not be able to provide a scan or photograph of the original slip to the Promoter on request, they will be disqualified. The slip is not to be written on or tampered with in anyway.
      4. All prize finalists will be subject to a verification process. Winners will be confirmed only once the verification process has been completed.
      5. All prize finalists, including the Grand Prize finalist, will first be notified via telephone within 72 hours of the draw, on the number used to enter the Promotion. In the event that a finalist is not contactable for 3 (three) consecutive days (3 contact attempts) then such finalist will forfeit their prize and another finalist will be randomly selected and the same process as described herein will be followed.
      6. Please note that no other Mondelez South Africa (Pty) Ltd products are eligible for this Promotion, other than those products mentioned above.  The qualifying products are subject to availability at time of purchase.
      7. All prize winners (including the winner of the Grand Prize) will be required to complete a form that will provide details, information, indemnity and relevant consents and any other applicable data as requested which is to be returned to the Promoter.
      8. The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as  determined by Promoter in its sole discretion.
      9. The Promoter reserves the right to withdraw the prize and/or disqualify any participant/winner that may bring the Promoter brands into disrepute.
      10. The Promoters may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities
    8. INDEMNITY
      1. To the extent permitted by the Consumer Protection Act and any other applicable law:
        • The participant and/or winner(s) hereby indemnifies the Promoter, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants entrance to the Promotion.
        • The Promoter excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).
        • The Promoter reserves the right, at any time, to verify the validity of participants (including but not limited to a participant’s identity, age and place of residence) and to reject any participant who has not complied with these Terms and Conditions.  Errors and omission may be accepted at the Promoter’s discretion.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
        • Neither Promoter nor its agents or distributors will have any liability in relation to this promotion.
        • By participating in this promotion, participants agree to allow Marketing material to be sent to them from the Promoter during and after the Promotion Period.  Participants will have the option to Opt Out with every SMS received, with the exception of the first sms
    9. CONFIDENTIALITY
      • Participants of this promotion are voluntarily providing their personal information to the Promoter, its associated agencies and the third party service providers running the promotion in conjunction with the Promoter
      • By entering this competition, participants authorize the Promoter to collect, store and use (not share) personal information of participants for communication or statistical purposes. Participants are entitled to decline any marketing communication and inform the Promoter in writing should the participant wish to be removed from all communication.
      • By entering this competition, the participant consents that the Promoter  may use names and  images taken of the winners/participants for publicity purposes, without any further remuneration being payable to the winner.  All promotional material will become the sole property of the Promoter.  However, the participant/winner has the right to decline participating in any promotional activity or to object to these images being used by written notification to the Promoter at 13 Harrowdene Office Park, Kelvin Drive, Woodmead, Sandton, 2191, Attention: Legal Department.  The written notification is to reach the Promoter by no later than the last stipulated draw dat
    10. GENERAL
      • Participants of this promotion are voluntarily providing their personal information to the Promoter, its associated agencies and the third party service providers running the promotion in conjunction with the Promoter
      • The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonable deems necessary
      • The onus rests on the participants to check the website for updates to the Terms and Conditions.
      • No liability shall lie on the Promoter in favour of any participant, winner (s) and/or third party arising from such cancellation, suspension or termination.  Therefore the participant waives his/her right which they may have against the Promoter and hereby acknowledges that they will have no right of recourse or claim of any nature whatsoever against the Promoter.
      • The Promoters decision is final, and no correspondence will be entered into. This promotion is in no way sponsored, endorsed or administered by or associated with Facebook.
      • In part or all of any clause of these Terms and Conditions is illegal, invalid or enforceable:
        • It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;
        • It will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
      • Any dispute with number ownership (such as more than one individual claiming to be the owner of the same number – verbally or otherwise) will result in immediate disqualification of both the number and the individuals and no negotiations will be entered into.
